Abstract
विवाह मानव समाज की सबसे महत्वपूर्ण सामाजिक संस्थाओं में से एक है, जो परिवार निर्माण, सामाजिक संगठन, सांस्कृतिक निरंतरता तथा नैतिक मूल्यों के संरक्षण का आधार प्रदान करती है। भारत जैसे बहुधार्मिक एवं बहुसांस्कृतिक देश में विवाह एवं विवाह-विच्छेद से संबंधित व्यवस्थाएँ विभिन्न वैयक्तिक विधियों द्वारा संचालित होती हैं। इस अध्ययन का उद्देश्य हिन्दू एवं मुस्लिम धर्म में विवाह एवं विवाह-विच्छेद की धार्मिक, सामाजिक, आर्थिक, मनोवैज्ञानिक तथा विधिक अवधारणाओं का तुलनात्मक विश्लेषण करना है। अध्ययन में सैद्धांतिक (Doctrinal) एवं तुलनात्मक (Comparative) शोध पद्धति का उपयोग किया गया है। शोध के लिए हिन्दू विवाह अधिनियम, 1955, विशेष विवाह अधिनियम, 1954, मुस्लिम वैयक्तिक विधि, प्रमुख न्यायिक निर्णयों, पुस्तकों, शोध-पत्रों तथा विधिक साहित्य का विश्लेषण किया गया है। अध्ययन से यह ज्ञात हुआ कि हिन्दू विवाह को परंपरागत रूप से एक धार्मिक संस्कार माना जाता है, जबकि मुस्लिम विवाह (निकाह) को एक वैधानिक अनुबंध के रूप में स्वीकार किया जाता है। तथापि दोनों व्यवस्थाओं का मूल उद्देश्य परिवार संस्था की स्थिरता एवं सामाजिक व्यवस्था का संरक्षण है। शोध के निष्कर्ष दर्शाते हैं कि शिक्षा, नगरीकरण, महिला सशक्तिकरण, सामाजिक परिवर्तन तथा न्यायिक सक्रियता ने विवाह एवं विवाह-विच्छेद संबंधी पारंपरिक अवधारणाओं को प्रभावित किया है। शाह बानो बनाम मोहम्मद अहमद खान (1985), डेनियल लतीफी बनाम भारत संघ (2001), शमीम आरा बनाम उत्तर प्रदेश राज्य (2002) तथा शायरा बानो बनाम भारत संघ (2017) जैसे निर्णयों ने महिलाओं के अधिकारों एवं लैंगिक न्याय को सुदृढ़ करने में महत्वपूर्ण भूमिका निभाई है। अध्ययन यह भी स्पष्ट करता है कि विवाह-विच्छेद का प्रभाव महिलाओं एवं बच्चों पर अपेक्षाकृत अधिक पड़ता है। समग्र रूप से भारतीय वैवाहिक विधि व्यवस्था संवैधानिक मूल्यों, सामाजिक न्याय एवं लैंगिक समानता की दिशा में निरंतर विकसित हो रही है।
